Issues with the I.R.S.?

I've been audited for the past 5 years. Two years ago I hired an accountant. I'm still being audited. I itemize my deductions and I always get an answer back saying I made a mistake and they give me standard deductions instead of itemized. Then they pop a hugh amount and say this is what I owe them. I should be getting money back. This last time, they had me listed as a small business owner. I'm not and never reported that I was. I can't believe how screwed up they are. Any advise on who to talk to. The gale who thinks I have a small business is on vacation until the end of the month and they are charging me interest on the money "THEY" think I owe them.

If you are still audited two years in a row with that accountant doing your taxes, you need another tax preparer. It seems that you and, now your accountant as well, are making the same mistake over and over.

You can be listed as a small business owner if you have any earned income from self-employment. Those deductions would not be itemized on Schedule A.

Get yourself to a good preparer who can review the past years still open. They will be able to prepare an accurate and acceptable return.

I don't see calling to argue with the IRS as a productive use of your time. Retain a preparer who has experience in tax representation, and have them deal with the IRS for you.
You need to take your past tax returns and letters from IRS to a another tax person for help.

Short of that, try to go to a local IRS office for help.
have you ever filed a schedule c for misc. income? This maybe why you are having this trouble. Take your letter and past year return to an H&R block year round office and speak with an enrolled agentif one is available and he or she should be able to help you; this service is offered for free as long as their are no forms filed on your behalf.

If you can back up your itemized deduction to the IRS, then you shouldn't have any problems being audited. You need a tax professional to deal with this. You DEFINITELY don't want to give more information than what IRS has asked for. They are professional collector. In your case I suggest that you hire someone professional to deal with this. You may think you owe them money but perhaps you do not. They presumed what you owe based on the information they looked at on your returns. They are not necessarily right. My first question would be: Before this problem began 5 years ago, had you ever had issues with the IRS? Did you ever give them a sound reason to want to audit you so often? What is their rationale for considering you a small business owner? A lot of information would have to be considered in order to accurately answer this question.
