Claiming back from the IRS?

Hi, I'm in the UK and have a trading account with an online brokerage to trade in the US. I did a trade and the brokerage automatically deduced 30% of the value and passed it on to the IRS in the USA. I should'nt be taxed as I am not a US resident or citizen. I clarified this with the brokerage and passed on to them a W8 BEN form to register my status. They told me if I wanted to claim back the amount, they could'nt do it, and that I would have to claim it from the IRS instead. How do I claim from the IRS? Can someone tell me how to go about doing this? Any help will be deeply appreciated !

First if the money was sent to the IRS it was sent under a specific taxpayer identification number that identifies you. Gather the information that shows you are not required to file a tax return with the IRS and attach it to tax form 1040NR-EZ (nonresident alien easy return) and ask for a refund. You will have to wait a few months for the tax forms to come out. You can find full information at www.irs.gov and print the form from the computer. Make sure you attach complete information explaining why you don't owe any tax to your return. Attach a copy of your W8 BEN. If the IRS agrees with your info they will send you a 100% refund.

The best I could find is form 1040NR U.S. Nonresident Alien Income Tax Return. You would be required to file this form if you owed taxes on US source income. My guess is you use the same form to claim a refund.
