I am 22 years and married and in college can my mom still claim me on her tax return ?

However, if neither you nor your spouse are required to file a tax return, or file a return only to get a refund, it is possible that your mother can claim you. In this case, the "joint return" test does not apply, This is an exception for married children only.


If the "joint return" test doesn't apply, then it may be possible that you could be a "qualifying child" or "qualifying relative" of your mother.

Conditions for "qualifying child":

1. You are under 19 or under 24 and a full-time student.
2. You did not provide over half of your own support
3. You lived with your mother for at least six months (or your mother's house was your home while you were away at college).

Or, if the above conditions are not satisfied, she could claim you as a "qualifying relative" if

1. You lived with her all year
2. Your income was less than $3,400
She can only claim you if you are a full time student and under 22 and are single. Being married takes you away from being her dependent. The only way that she can claim you is if both of you are living with her, are both under 22 and are both full time college students. Thats it. Most likely i wouldn't try it, and since your in college you would most likely get a better refund then if your mother claimed you.

IF YOU WERE NOT MARRIED DURING THE YEAR IN QUESTION...THEN YES IF U ARE A STUDENT SHE CAN CLAIM YOU UP TO 24 YEARS OLD.I HAVE A COUPLE OF DIFFERENT CLIENTS WHO THE STUDENT MAKES ENOUGH TO HAVE TO FILE HER OWN RETURN, AND SHE DOES NOT LIVE AT HOME DURING THE SCHOOL YEAR, HOWEVER THE PARENTS PAY FOR THE CAMPUS RESIDENCE ADN THE TUITION ADN OF COURSE WHEN SHE IS OUT OF SCHOOL, AND BY HER PARENTS STILL CLAIMING HER SHE LOSES AROUND $150 OF WHAT HER REFUND WOUDL BE IF SHE WERE NOT CLAIMED ON THE PARENTS RETURN, BUT THE DIFFERENCE ON TEH PARENTS RETURN THIS YEAR WAS OVER $900.0 AND THE PARENTS PROVIDE WELL OVER 50% OF HER SUPPORT SO THEY RIGHTFULLY CLAIM HER...
AND FYI THE STUDENT BETWEEN 19-24 IS NOT OLY A DEPENDANT BUT CAN STILL EVEN QUALIFY THE PARENT FOR EARNED INCOME CREDIT

OK SO IF MARRIED REGARDLESS YOU ARE TO BE FILING MARRIED, BUT IF NOT DID THE PARENT PROVIDE FOR 50% OF THE SUPPORT ...AND IN MOST CASES WITH STUDENTS THIS IS THE CASE
