Promoters selling flats asking to pay 4.059 % as service tax payable on cost of flat + car parking.is it ok?

There is no service tax if the builder is constructing the flats on his own.However, if the builder gives a contract of construction to a contractor; the contractor will be liable to pay service tax at the rate of 12.36 per cent on 33 per cent of the contract value.
