Returns policy in a clothing shop>?
Answer:
no
if you are trading in the UK, or elsewhere in the EU and selling goods to people not present then any sales are covered by the distance selling legislation. thats any sales (by phone, fax or internet). its arguyable if it also covers sales to non EU countries, but I bet it probably does.
people advising you that you can refuse to accept anything back except faulty goods are wrong - they either ignorant of, or flouting the law.
you must permit the purchaser to return the goods for a FULL refund - you cannot impose any conditions or preconditions (expcept possibly postage), you can and ought to specify a period which is reasonable for the customer to approve or assess the goods.
the customer doesnt have to give any reason to qualify for a refund, you can ask, but you have no right to demand or withold payment
you can put an explicit time limit on what is reasonable (generally accepted custom and proactise indicates that its 28 days from receipt of goods (NOT dispatch)).
it doens't matter if the goods have been opened or used if the customer doesn't want 'em they are yours, providing they inform you within the specified time limit, even if the goods dont return within the time period.
You are only legally obliged to accept returns where a) the item is not as described or b) the item is damaged.
Under no other circumstances do you have to accept returns.
They cannot return items they don't like or that don't fit unless you have incorrectly described or mis-sized them.
You can stipulate no returns but a lot of people might not want to buy if they can not return unwanted items.
The shop legally only has to exchange or replace faulty goods if they are supplied as described.
As a consumer, I would not purchase from your store as there is no option for trying on the clothes. People prefer to order 2 sizes to make sure they get the right size. This would not be an issue if designers stuck to one sizing guide.
The Distance Selling Regulations specify that if you sell on line you are obliged to accept returns even if the products are not faulty. However, you are allowed to specify that in such circumstances the purchaser must pay for the cost of the return.
