How do i take legal action against a company or an individual if they break contract?

i own a small biz. so if there is a company or an individual who breaks contracts and mutual trust, how do i take legal action against them within affordable fees?

Call the lawyer (ca-ching!) Bring lots of cash, though, since lawyers aren't cheap. It may cost you LESS to take the loss rather than hire a lawyer, get out your calculator.

Contact the chamber of commerce; you may score some free (already paid for with taxes) expert advice.

Definitely report them to the BBB; others need to know they aren't a good business. While it may be tempting to spray paint the problem on their building, you might very well get busted for that.

You should be able to prove the other party did not perform their duties of the contract, and the court will force them to make good on the contract.

Whilst mutual agreement is all well and good, it is only your word against theirs. You need to prove an element of good faith about the mutual trust, relating to whatever clause they breached.

If the other party breaks the contract and the contracts say you can claim for this and that if they do break it then you have grounds for claims. You should have attempted to claim what is stated in the contract. And have proof of this e.g. like a registered letter.

Consult your lawyer. you should aready have one. No matter how small your business is you should have a legeal advisor and a tax advisor. Sometimes a friendly letter on a lawyer's letterhead may fix or settle a problem. To many small business skip the lawyer part.
