Does a company legally have to with-hold childsupport....?
Answer:
If it was court ordered I don't think u have a choice.
when a company with-holds child support they are doing so by court order..a judge has made this decision and not the mother of the child and it is legal..the company has no choice but to with-hold the wages for child support....sending in money occasionally is not acceptable...EVERY time the man is given a paycheck part of his wages MUST be with-held and given to the court for the support of the child.if he did not earn a paycheck then there is no money that can be with-held..by sending in money when HE asked and not following the court order it seems you have ignored the court order and now you may be in trouble and ordered to fork over the money that should have been with-held EVERY time the man made a paycheck and not just when he asked the company to do so..the decision for wage with-holding is not HIS choice to make it was the ORDER of the court...it seems any business owner would be educated about these things.who is running this company?
Yes, it is legal because it was court-ordered. Something you may want to think about as the employer who is reluctant to send that in, is that the mother of the child(ren) went without for those times that you were to submit a payment. Please submit those payments as soon as possible for the sake of the children.
