We bought a home. The owner asked for a 15 days rent back but do not want to leave it. What can we do?
Answers:
You can start eviction proceedings. They will be forced out by the marshall. It will take them approximately 5 days to get out to the home to post an eviction notice. They usually give them 24 hours to clear out otherwise they lock them out.
What?
what state are you in?
you should begin eviction proceedings immediately!
If you bought the place, it's yours. Presuming you have the title, call the cops and have them thrown out.
Check your sales agreement. Since the transaction was completed on May 1, you have the right to charge the ex-owner rental effective May 1. However, its best to have this in written contract.
I don't know what state you are in. In California, you give them a three day notic e to quit. Then you file an unlawful detainer lawsuit. There are self help books available, that tell you how, but you will probably want to get a lawyer. In California there is an organiztaion called the Apartment Owners Asssociation. Their monthly magazine has ads for eviction attorneys. Hope this helps.
Since you rented to them they might have rights under the landlord and tenant act. I know the Oklahoma act says you have to give the renter a written notice to get out. The renters have 30 days from the day you give them the notice to vacate. If they refuse to leave after 30 days then you can commence with eviction proceedings.
You might be able to sue them for damages if you had a financial impact because of their not moving out; pay for a hotel room, for example. I would talk to a lawyer about that though.
