Can you refinance a house if you are in the middle of bankrupcy ?

about 2 years ago my husband had cosighned on a house with his dad. we are now looking for a house, but can not get one because his name is still on that other house. now we were told that my father -in-law can not refinance the house until bakrupcy is over. is this true? (oh and the house was not included in the bankrupcy.)
