How to cancel a contract with a realtor after just signing .?
Answer:
I wpould ask a lawyer for this ones advice or you could contact the company he works for Im sure he has a boss .
Is he the broker of the company or just an agent? You might be able to contact his broker and explain your mother's concerns and terminate the contract. If he is the broker, then you should probably tell him you have no choice but to hire a real estate attorney.
Do NOT go to the agent's boss, who do you think hired him to behave the way he did in the first place.
A serious issue to consider is that your mother is a senior, there should be some laws in protecting seniors who are been taken advantage of. In other words, no other family members was there assisting your mother, due to her age. I would go to a lawyer immediately.
In order to cancel the contract within 72 business hours, it always has to be sign such as FedEx or UPS in overnight delivery only. This way they cannot deny in receiving the documents. It had happened to me, and I almost got scammed for $10,000. With the evidence, the credit card company backed me up, so the company loss the scam deal.
If the address had the P.O. Box, it could only be processed through the United States Postal which I believe is illegal because United States Postal doesn't do overnight delivery.
I suggest you talk to the agent and explain to him that it is important for your mom to have an agent she feels 100% comfortable with. If there is something this agent can do to earn her trust you should lay it on the table. If there isn't anything he can do, then you should explain to them that it is in their everyone's best interest to cancel the contract. You can also threaten to escalate the matter to his brokerage firm if he doesn't agree and actually escalate it to them.
I answered this one in your other posting.
choices:
1) go to his boss-- Realtors are licensed by the state and are legally obligated to obeying the law -- he cannot tell you that you can't cancel the contract if it is within the 72 hours
2) if the 72 hours is past you will need an attorney
3) contact the state licensing board in your state (go to your state's official web site for their email address, telephone number and mailing address, have the realtor's name and brokerage firm name in your hand when you call because they will need that information.
All Realtors are licensed by the states that they sell real estate in. They are governed by state and federal laws. They can also be sued for malpractice, and this realtor's behavior is clearly malpractice.
See an attorney and don't let this matter slide. He needs to be removed from the roster of Realtors in your state as he gives the rest of the honest Realtors a bad name.
A reputable ageant will let you out of the contract if you change your mind. Read the contract or have a lawyer look at it. Some buyers agreements with agents have a mutual cancelation clause which allows either the client or the agent to cancel the contract without cause with written notice. If he/she does not let your mom out of the contract just dont look at anymore propeties with that person and let it expire. If you chose the latter get a REALTOR. REALTORS adhere to a strict code of ethics, I have been one for 7 years.
