I evicted my tenant and got a judgement ($5000.00).?

how do i garnish their wages? do i have to go through small claims court? or can i just file with the judement i already have? i live in marietta, ga cobb county

Did you get a judgment for possession or a judgment for possession AND a monetary judgment for the back rent?

If you got a monetary judgment, the clerk at the court can tell you how to proceed.

If you only got a judgment for possession, you will have to file in small claims for the money and proceed from there.
I believe you need either a lawyer to hire or a lawyer friend that is willing to help. There are miles of red tape.
Just because you won the case, if they do not pay you, you can put a judgement on them, but, if they have no money (You can not get blood from a turnip)
Most states require you give a 60 day notice now. I run a apartment complex in St Paul Mn and they are going to change it to 90 days notice. However, depending why you evicted them you can get that reversed! If it is like Drugs or something bad, but if it is just they owe you money or they are loud, you will never win!
