Prescriptive rights are most often used in tandum with adverse possession and in relationship to easements not to property takings as a whole. Each state of the union differs in the requirements to attain adverse possession which a prescriptive right of use is. In all cases that I am aware of to prove the right and take the property you must go to court. But you can certainly find all this out yourself.
