I've been a property manager for many years. The procedures and laws vary from state to state. Generally speaking, eviction can only take place if you have petitioned the court to dispossess the tenant (i.e. order the tenant out) and restore possession of the property to you. The process begins with notification to the tenant that they owe rent and need to pay it or vacate (non-payment) or that their tenancy has been terminated because the lease is not being renewed or they breached it and they have x amount of days to vacate (holdover). There are different types of legal actions depending on the situation, usually non-payment or holdover (meaning you ended the tenancy but the tenant refused to leave). The legal action would result in a judgement and then, if the tenant refuses to leave, you can ask for a warrant of eviction. The eviction would be carried out by the marshal or sheriff or whoever is authorized to execute it in your jurisdiction.
You may be able to navigate the process without a lawyer (pro se). That depends on the law in your state. In any case, you should go to the landlord tenant court and get advice as to how to proceed. Pay a small fee and get decent forms either from Staples (on software) or a legal stationary or online. You can do collection and notice to vacate yourself. For a dispossess you should get legal advice because there are things you need to know (eg is anyone in the military in the family because that requires different procedures).

What i believe, u can't get free forms for eviction. The website that REBAL said did not provide the proper form that is need to start an eviction. it only gives u a letter explaining to the tenant how an eviction will effect them in the long run. First, you have to go down to the courts and start an legal eviction. Second, pay filing fees and then go from there. If u do and eviction without the courts involve or the shiriff involve and u lock out the tenant or throw thier stuff out without the legal way, YOU can lose your case and the tenant will win.. The courts will look at it as an Illegal Eviciton. So don't go for anything free. If the tenant pays up u can stop the eviction process. But do it legally or u will lose ur case.
