A person gave real estate to her kids then goes into a nursing home?

the woman has savings and insurance but the cost of care is quickly eating that up. Can the state of Michigan come back to reclaim the real estate to cover her expenses? Her spouse is deceased.

The answer depends upon how long ago the house was signed over to someone else. Check up on current regulations. I know the State of Pennsylvania recently revised the statute upwards to prevent older folks from avoiding paying for long term care simply by divesting themselves of real estate. Check with a local agency on aging. Also, much depends on the way in which the property was donated. Was it done with a purchase price or as part of a trust? You may need to get an attorney who specializes in Elder Law involved.
If she transferred the real estate 2 years before she APPLIED for assistance, then no. If under two years, then yes.

No she gave the property to her children simply because that makes her eligable to go into a nursing home and not lose her home.she had rather give it to her children for their inheritance,and I think she did the right thing.Those nursing homes would want to take her to the cleaners,she used her head when she did that,those people want to know if you have anything so the state can get it,they are like thiefs..My Mom had a life insurance policy and she put it into my sisters name,and that way my sister owned the policy,and my Mom went into a nursing home,when My Mom passed away we used that policy to give her a beautiful funeral.If my Mom had left that policy in her name(and the nursing home did ask) they would have wanted to own that policy and we would not have been able to bury our Mom,cause the responsibility would have rested on us and we had limited funds..Nursing homes want all your ss check less $25.00 and if you have any property they want that too,its unfair.Hope this helps
