Can I keep the money if the contingency period expires with no deal?

If I draw a cheque sent to my as a deposit for an appartment I am selling and if the contingency period I have imposed expires with no contract signed, can I keep the money?

I don't understand your question fully. Has the purchase contract been signed by both parties? You say that the contract has not been signed. If this is correct, there is no contingency period because there is no binding contract. If both parties have signed an agreement to purchase/sell, and they cannot close it within the time you've specified and agreed upon, then the deposit is yours.
