We bought a house in June of 06. We have a warranty on the house for 1 year, expires next month. Are house was built on clay, we did not know this, we bought after it was built. The house is cracking everywhere. What are our rights, and if needed what kind of attorney do I need to contact about this. I have told the builder, who sent in a drywaller and mad matters worse, now I have to repaint. Even the drywaller couldn't fix everything, and said the builder would have to.

The warranty company will not cover what you are talking about. Speak with an attorney they can give you options as to fixing your situation.
Never heard of a house built on clay before. Did you have a home inspector come through before the purchase? IF not I would have one determine the extent of the problem in this and get it documented. Then I would file a claim in court in such as small claims or see if there is some dept. there where the courthouse has hearings held for such matters and file a grievance that you were sold a house that is unliveable. I don't see why you can't get a lawyer that handles general wrongful doing lawsuits and discuss this. Try to get a free consultation first to not have the added legal fees then.
