We signed on with a realtor to sell our house over a week ago, is there any way to void that contract?
Answers:
The same with any contract. To stay out of court you will need to have them agree to cancel the listing. I would tell them I want to list with someone else at another company and I want to do it right now-so I want it canceled with no waiting period.
Some companies will do that, others will not. I know one large Real Estate company that refuses to do this (says something about what a bad company they are I think). Most companies just release your listing at no cost and try to learn how to please the next customer better.
If you were to go to court you would need to show where they promised to do a specific thing by a specific time and that was not done.
Sue the company.
You tell her that you are not going to use her services anymore. Since you signed a contract, alot of times there is language in there that states you cannot use any other realtor for a set period of time...usually it can be anywhere from 2 weeks to 3 months. Just because you signed the contract does not mean you have to stick with that person to the bloody end...
You can have it withdrawn. You will be under a protection period with the company (usually ranges from 30-180 days) where you will not be able to list it with another agent or sell it yourself without giving them the commission you originally agreed on. If you have any questions or want me to look over the listing agreement then just email me.
Look the contract over to see if there are performance requirements or language the parties responsibility (buyer
and seller).
If you can void the contract, at the very least, you will not be able to sell the house to anyone the Realtor showed the house to without paying a commission.
If you can't void the contract go to the Company and ask for a new listing agent.
Good Luck.
