1/2 tenants + landlord sign lease, is it binding if tenant 2 has not signed yet? contract not even 24hrs old..

My boyfriend and I are trying to rent a home, he and the landlord have already signed, he has also already given $4000 towards 2 months rent & security deposit. However, they are still waiting for my signature. Turns out the house is a filthy infested death trap. We have to get the hell out of this ASAP!! Is this contract leagally binding if my name is on the lease but I have not signed yet. Also not even 48 hours old. HELP PLLLEEAASSEEE!!??

Go see a local attorney asap, as you want to get your money back if possible. Renting a dwelling includes a warrant that the place is habitable and livable. If the property does not meet your state's and county's laws, the partially signed contract may be void. Contracts are also invalid or voidable for other reasons including fraud, deception, lack of licensure, etc. Your attorney can review the contract, and your facts to dtermine what rights or liabilities you have.
In the future, always examine the property during the day and at night, before signing.

If it is in NJ and your lease is for a year or more, you can get out of it within 3 business days by having an attorney cancel the lease on your behalf.

If I were you, I would go to a landlord/tenant attorney today and get their opinion on how to get HIM out of this mess. Since you neither signed nor moved in, you are off the hook.
