Can I get my bank charges back?

I have heard that if your bank charges you over £12 it is unfair and you can request the money bank, if they dont cough up you can take them to small claims court and get it back. Does anyone know if this is true? and is there anyone who has been successful if it is true? my bank has had £240 out of me over the last ten years

Before you get on your legal high horse my suggestion is that you just talk to your bank say that you find the charges a bit steep & ask if they can do anything about them. Be reasonable and non-confrontational in your approach. I have found this strategy to be effective. I am not sure about the rights & wrongs of your particular case but before you spend your time energy and money on legal proceedings try the personal touch.
I'm in the US so I don't know about this small claims thing, I don't think that would work here. However one thing you can do if you have overdraft or other types of excess fees, you can call and request them to waive the fees during the current time period. Most banks' customer service departments will do it for you occassionally. They aren't going to waive the whole year, but maybe a few fees. My last bank even had a policy, one waiver per year, and I got I think 3 or 4 USD $25 charges reversed.

In theory, you can.

If you have gone overdrawn, you have taken money from the bank without their permission. This is Theft. If you think that you are entitled to steal money when you feel like it, and not get charged for it, you can write to your bank a simple letter sayng you think the charges are unreasonable, and you want justification for it.

If you send them such a letter, they need to reply in about 21 days to break down what the charges are for, and they may refund all or part of your money. If they don't, you can reply that you want a refund, and you are willing to go to court with this case.

Consider this: If I went into your account, and took some money out of it without your permission, would you mind? More so, would you expect some compensation for me going into your money? This is exactly what you are doing to the bank. You are taking their money without their permission, and not giving any compensation for your theft.
