What chapter should I file? Please Help?
Answer:
For starters, I do not recommend filing bankrupcy over $6000 in debt. If you file Chapter 7, that will completely wipe out the debt, but it will cost you several hundred dollars in filing fees and court costs.
Can I assume that sueing your mother and "others" who stiffed you is out of the question?
The only other option is to examine and prioritize your debts, and try to negotiate a lower payment and lower balance on these bills.
I just don't see bankruptcy as an option in your case.
Instead of bankruptcy, try Consumer Credit Counseling. They are a non-profit organization that will help you get control of these bills. $6,000 really isn't that much, and they can get you on a debt repayment plan that will give you some breathing room.
you need an attorney's advice. if they agree that bankruptcy is the RIGHT thing to do, then get another attorney! why screw yourself out of job and housing opportunities for the next 10 years of your life? If you think you have stress now. just wait.
Do not declare bankruptcy for that little debt. It will put you in a worse position. If you are ok with doing this, sue your mom and others in small claims court. The max in some states is $5000. If you can secure a judgment against her or the others for the debt, show the companies a copy of the judgment as they can no longer hold you responsible for those bills as it has been legally established that these bills were the responsibility of others.
They may never pay you, but at least you have repaired your credit and are no longer legally responsible for the debt.
If you are successful, do not lend your credit out to others. There is a reason why these people have bad credit and they are not going to do better just because the credit is yours.
