I would call your local Clerk of Probate, Probate Court in some areas. They deal with estate matters and such. They can tell you what needs to happen to keep things legal and all.

hi im not sure how it works in utah but here we can go to the post office or news agent and buy whats called a statuary decleration, get your brother to fill it out have it signed buy a justice of the peace and your done, it becomes a legal binding document and costs next to nothing, hope this helps
