Im assuming what you are asking is how to get an insurance company to settle before the statute of limitations runs. Dogbite claims are generally found to be 100% the responsibility of the owner. So the only other point of contention between you and the insurance company is how much the bite is worth. Im guessing they value it to be worth less than what you value it to be. If you cannot come to an agreement your only course of action is to file suit to ensure that the statue of limitations does not run. I would reccommend that you call the claim rep. who is handling this and discuss the claim with them.
They don't HAVE to settle. If you don't file a lawsuit, or retain an attorney, they're a lot less likely to settle.
Of course, an attorney is going to take 30% of the "settlement" or judgement. But if you choose not to sue, they have NO obligation to hand cash over to you!

I don't know what you mean "runs out". If you filed a claim with the company, there is not time limit. There is a time limit, however, to file the claim. If it's in the process, it will take as long as it takes.
