i live in ontario canada. work in unionized retirement home. i've been there almost 7 years. recenetly decided i need a benefit plan to pay for some of medical expenses, not much but it adds up! i applied, then told after 6.5 yrs i need to fill out a medical questionare. then denied on grounds of relation between hieght and wieght. other employees whom applied got it just by signing up, no questionare. is that legal, can one employee be denied and not another? is that discrimination? anybody know the law? what the hay!!

I'm not sure if this applies to your situation, but many companies do further research on your medical background if you have not been covered by insurance within a certain time period. If you pass the initial medical screening, then they will offer insurance, but they may not cover certain claims within a defined period. Finally, you would become eligible for the entire benefit of the plan. It is my understanding that this is done to discourage people picking up the insurance plan when they discover that they have or that they are at risk of developing a certain condition. I have not heard of company sponsored plans denying a particular associate before. Normal insurance companies do take very complete medical histories before granting policies.
