The hydrocarbons industry in Venezuela is currently governed by the Organic Hydrocarbons Law (“Hydrocarbons Law”) and by the Organic Law of Gaseous Hydrocarbons (“Gas Law”). Although both laws were enacted by the Government through delegation of powers from the National Assembly, they provide two distinct regulatory systems. One is a petroleum regime that reserves hydrocarbon activities to the State and, with exceptions in some areas such as new refining capacity, discourages further private investment. The other is a gaseous hydrocarbons regime characterized as non-reserved and designed to attract private investors as the dominant players. However, in key areas such as liquid natural gas (LNG) the government has decided to retain certain level of participation.
At the end of the year, the Ministry of Energy and Mines will likely award three to four offshore natural gas blocks in the Deltana Platform to several international companies. The Gas Law and its Regulations permit a bidding process conducted by the Ministry of Energy and Mines. In addition, a direct adjudication for public interest reasons or for special circumstances is also allowed. These two possibilities are being considered by the Government in awarding such blocks.
