IT IS NOT ILLEGAL BUT IS UNETHICAL AND WILL COST THE BUSINESS ALOT IN GOODWILL .
It's illegal I think under ' false advertising '. They can use that as an excuse just to get you into the styore and stick you with something else.
Very common business practice for literally ages.
And that is the way out of the dilemma. When you see an ad for something on sale, there is always a disclaimer that qualifies the sale by saying that if delivery is not made, the store cannot be held responsible.
If they intentionally advertise it knowing its not available, then try to sell you a similar product instead, it is called a bait and switch, and that is illegal.
