Has this ever happend to you?

I bought a cd from amazon .com i waited with anticapation to listen to it finally i got it opened the packaging and the case [bought used] and there was NO CD... what do i do now i contacted the seller via email and they said they would refund shipping but hello! why shouldnt i get back the whole refund no body would just pay for a cd case!! what do you think i should do?

Answer:
I think you may send a 'Legal Notice' first citing your rights and their liabilities with consequences if they fail to fulfill their part of the contract of such purchase. If the response is in the negative then file a lawsuit and let them face the music!
Amazon will take care of you if the seller wont. Happened to me with a book, got the wrong one and seller said tough sh*t.amazon gave me an entire refund.was easy.
it's never happened to me but that would suck.and you can't prove to amazon that you didn't get it.just keep complaining and writing letters till they do something.

I ordered from amazon UK and was super disapointed the DVD wouldn't play in my player..any of them for that matter.
