I paid off a morgage lone about 11 years ago and now they say i still owe i have no proof what can i do?
Answer:
Respond in writing to their letters. Ask them for a detailed accounting of all payments and balances. Keep a copy of the letter for your records. At the same time, go to your bank to find copies of all checks you wrote to pay the mortgage. Use your check register to zero in on check numbers. Try and reconcile their records with yours. If you owe, then pay.
If your records confirms your full payment, then send them the copies of the checks and an accounting of your complete payment. Make sure you save copies of everything you send them.
If they fail to provide you with any information, then continue to write letters requesting a full accounting and make sure you save copies of all letters you write.
If they send you a demand letter threatening litigation and you believe you have made full payment or they have not provided you with information, then take all your letters and all of their letters (save all of their correspondence) and all your payment records to a lawyer and see if you have a case.
If you have a copy of your statements then it should show a zero balance. Just show them a copy of the statement that shows it paid off. You should always keep a copy of your paperwork. If you don't have anything then you may need to consult an attorney to help you fight it. In fact, that's probably what you "should" do anyway.
That wasn't very wise of you to keep no record. If you paid off your loan to a mortgage lender they should automatically send you the title to your home, just like they do when you pay off a car loan. If you never recieved the title, then you may not have paid off the loan.
Nice life lesson. When dealing with something as important and large as a home loan.. keep the paperwork.
I am not going to lecture you, you don't need that.
I have never paid off a mortgage, but check woth your home owner's insurance, until the mortgage is paid off, they would have to be on the paperwork. I would think they would need proof of the pay off of the mortgage, so if that paperwork was changed, they would probably have it.
If I think of anything else, I will post it here.
Good Luck!
First thing I would do is contact the president of the company that held you loan and make sure this isn't a scam. I worked in banking most of my life and have never heard of such a thing. It doesn't take 11 years to realize a loan is not paid. It might take a month, that's even stretching it. Has the company been bought out buy another company? If they are claiming it is truly not paid off then CALL A LAWYER , before they try to take your home. Because they obviously are not very professional if they lost a loan.Good Luck.
