I have been in Chapter 13 Bankruptcy for a year and a half, what could happen if I am late on a payment?
Answer:
What does your lawyer say? My guess would be that they'd grab the money from your employer or assets any way they could.
The case could be dismissed for late payment but it is unlikely that it would be for a few weeks. This is particularly true if this is the first time that you are late in one and a half years. You should call the office of the trustee and explain your situation to them. Even if the case is dismissed, your attorney may be able to have it reinstated later but that will cost you more.
I think you have to start ur bankruptcy all over again.I've had a couple of friends that have been late ,and they had to go and start all over again.
Generally you can be late ONE time. The next time they will dismiss your protection. You have paid a lawyer a great deal of money to help you file. Call his office.Even the secretary will know the answer. If you are dismissed, no big deal it will take some time for your creditors to realize your circumstances. Even after they do you still have a couple months of their threats before they will take legal action. By then you will be back on your feet. You just go file again. The worst case scenario is that you will have to pay the lawyer again. Relax you are an Honorable person to have filed 13 instead of 7. I hope things will turn around for you soon.
