I have a charged off credit card balance and the only income we get is ssi. Can this ssi be garnished?

Also what happens if they put a lein on our home. My wife gets the SSI and I dont receive anything. The home is only in my wife's name and the balance is in my name.

No. SSI cannot be garnished. The Anti-Assignment clause of the Social Security Act, 42 U.S.C. ยง407(a), states that a person's entitlement to Social Security payments shall not "be subject to execution, levy, garnishment, or other legal process."

If it's been charged off it was most likely sold to a collection agency. The only way they can garnish anything is if: a. it is legal in your state, 2. it is a regular practice of the collection agency, 3. and they have exhausted all other efforts. See if they will take a settlement for less money.
there is no chance they can garnish a ssi check. If taken to court in a suite the judge will dismiss.
