When the ex and i got divorced we seperated the bills on the agreement now he wont pay his can i be sued?
Answer:
If the bills were in both your names, it doesn't matter that the divorce agreement stated that you would not be responsible for the debts. The creditor was not a party to your divorce, and they do not have to abide by the divorce agreement.
You can be sued for the creditors if your name was on the debts. To save your credit rating, you might have to pay the bills.
If your ex was ordered to pay the bills in the divorce agreement, however, you can file contempt of court against him for failing to follow the divorce agreement. The court could order him to pay on these debts. That doesn't mean he will, however.
If he files bankruptcy, he can include those debts and you in his list of creditors, and then he won't be liable for those debts any longer. If that happens, you will be the only responsible party. This is way, in the case of divorce, if one spouse files bankruptcy, the other spouse usually ends up filing also.
Good luck.
Yup. Under most agreements, you're both responsible for each other's debts. To be sure, consult your attorney.
if the separation of bills was actually written into the divorce decree by the court - then no he is responsible for them but if it was just something the two of you decided on - yes you are still responsible. Lesson here - get everything in writing
Not sure about being sued. But similar thing happened to me. Might have to go back to court for this one. Good luck.
Whatever bills your name is on, regardless of your divorce agreement, you are liable for if he defaults. The agreement was for your divorce, not for financing or refinancing. You can sue him for breach of contract but if he's not paying the bills, he's probably not going to pay you. The creditors will go after you before garnishing his wages.
