He then told me i have till the end of the day to pay off both of these, if i dont he has a local laywer ready to take me to court and this will cost you 7kPlus. He also told me he is going to try his best to get me for credit card fraud. both of these accounts were charged off back in 2000. I had some health issues. I dont have the 3k he wants know, can i get charged with fraud. i am worried.

Answer:
Hi. I used to work for NCO competition, Alliance One. There are fed laws called the FFDCPA Fed Fair Debt Collection Practices Act, that he is in serious violation with. Try to get the next conversation with him recorded on the phone. Then call NCO and ask for a manager. Tell him you have this recorded and you are going to your lawyer with it because it violates the FDCPA. Make him or her know you are serious. They will pay your debt and make you an out of court settlement before they allow that. And the guy who called you will be fired. Any questions, call or email me directly 215-962-2467 I worked with a law firm for years with these things. Mice C.
Some of those threats sound illegal - call your congresscritter.
If I understand you correctly, you did not pay those two credit cards and the credit card company quit sending you bills. They have now sold those debts to NCO. They likely paid the credit card companies about 10ยข on the dollar or less and have very little to use. They will try to exert as much pressure as they can to get you to pay. If you have assets, they can come after them. If you did only failed to pay the bills and did not commit fraud, then their claims are meritless. Most of these guys are going to nothing more than call you a number of times or sent letters. In order to get an attorney to take up the case, they will have to pay money up front. If they bought your debts for $100, they are not going to drop another $500 to $700 into a lawyer unless there is an excellent chance to collect. I would tell them to stop calling you because you have no money or any ability to pay.
They will tell you anything, they don't have anyone to answer to until you pursue the issue. They bought an old account and if you do not respond within 30 days that it is not a valid debt any longer, it reactivates the account, etc.

You should search online for information on this, but it is highly unlikely that they will pursue to the point that he discussed. They are just trying to pressure you.
don't listen to him. check your states statue of limitations. you are probably outside of the sol in most states. they will say anything to get you to pay them a dime.
Credit card fraud, NO. They were your cards what's fraudulant about that? They will tell you anything and NCO is a bad company. Call Mike C. I did exactly what he is talking about and guess what I didn't have to pay a thing. You have to be able to hold your ground and not sound scared cause they've been trained to be a***. You don't have to tell them you're recording the conversation, because if I remember correctly it says that it may be recorder when you call them. I was later told that I could have sued them for extra money and reported them and they'd be fined but I was just happy to get out from under that debt. Good Luck.
