if her son is legally an adult then it is theft, and she should report it to the police. if he is a minor then she is responsible for his actions and not entitled to reimbursement. the problem is they would have to 'prove' she knew he did it. that's where her conscious and moral compass comes to play. the really sad part is what lesson did her behaviour teach her son.

The banks know where and when the transaction happend. ATM's all have video cameras. They WILL review the video to see who used the card. They could then figure out that he is her son.
If they do this she could still claim ignorance and probably not be in trouble. However, they WILL go after the son. If she refuses to go along with it but does not give the money back then they will also go after her.
