My wife and I bought a car and now we are going to get a divorce. We both signed. How do I get sole title of car
Answers:
Get a personal loan to refinance the car and pay her off in exchange for her interest. Can't hurt to ask your lender if they have a preference for how they would like to see it handled.
She needs to be off title and off loan for both your sakes; could be part of the divorce settlement.
I would think your divorce lawyer could help take care of that. If not, then contact your lender. They hold the title until the loan is paid. Tell the lender that you are getting a divorce and your wife wants her name off of the title. They should know what to do. If, for some reason they can't help you then contact the Dept. of Motor Vehicles.
go to the bank and talk to someone in the loan department, tell them your situation, they will probably tell you to refinance the car in your name and they usually have secretary of state forms to fill out with just your name your wife will need to sign off on the title. you may call your department of motor vehicles and they will probably tell you how to get your wifes name off the title. hope this helps
You cannot get her off the loan. You can get her off the title. Be sure, in the decree, it stipulates that you get ownership of the auto. ONce the devo is final, go to DMV and just retitle. Keep the payments current, boss.
The only way to remove her from the loan is to refinance in your name only. Contact your current lender first, they may be able to help you. If not you will have to refinance through your own bank, credit union or another lender.
Once this is done the new title work will come to you in your name only and that all there is to it.
Do not depend on your divorce decree. They mean nothing legally. As long as your soon to be ex is on the loan she is still responsible for the debt if you default.
You have to refinance the car in your name alone.
you have to talk to the bank and tell them to remove her from loan, if she is willing then they will remove her and leave you on...
