Unfortunately, there's nothing you can do except look for a different job. Benefits are given at the discretion of the employer. It sounds like they're listing you as part time because, while they need you now 40 or more hours a week, they don't think that'll be a permanent situation, so don't want or aren't able to commit to you as full-time. I can see that they wouldn't want to give you benefits, then take them away if they had to cut back.
Or maybe they're just cheap.
In either case, about all you can do is look for another job.

Well I know that if an employer has X amount of employees they would have to provide benefits but if is less than the X amount no they do not.
I would check the department of labor from your city or state.
they are playing games with you , contact your state labor board and tell them what is happening, [be prepared to be dismissed for this] your employer does not like being reported, so they will find a reason to fire you.
