Would gender make any difference ? What if man has same circumstances ?

If she were only on leave, then yes, the time counts for her. If she had to be rehired after her leave, then the time only counts from that date. So, if she worked for you 4 years and was only on leave, then the entire 4 years count. If you technically let her go for 10 months then rehired, she would only get the time that she was employed after her leave. This is how alot of companies get away with not paying certain benefits. Because they can show that an employees has only worked a few months instead of years. Hope this helps.
And, it doesn't matter if male or female, it's all the same (legally).
The only way that would make a difference is if you were "rehired" after returning from your 10 month leave.
It should not matter if the person is on maternity leave. Her time counts just the same. The only exception is if she does not return to her old job. The same goes for the man who takes some of the maternity leave. They should not be penalized for having children.
