You can't ever be 100% sure.

You Do have to fill out federal form I-9.
This document requires the employer to examine documents that verify both Identity and Eligibility to Work in US. You must either see a birth certificate, or a driver's license AND social security card. (There are other optional documents-like green cards, student ID's, etc.)

While these documents CAN be forged, the employer is only obligated to swear that he/she examined them and that they "appear" to be genuine.

If you do this, even if the docs are fake, you will not be responsible.
The I-9..it is your job as an employer to fill this out and verify the documents.
Mow your own lawn.
Have them show you either a social security number (in which case they are a citizen) or a green card (in which case they are in the country as a guest worker).
You would have to be real racist and check everyone you suspect is illegal.
Thats easy, when you ask them to fill out employment forms and they dont have a SS# or drivers licence or some form of ID, there you go, they arent supposed to be here.
You call DHS and have them run their green card number. They can verify whether or not it is legal. Anyone can get a fake SS card or green card.
Ask for their green card.If they don't have one they are not legal.
Look for a space ship and shiney clothes.
Check their birth certificates, drivers licenses, social security numbers, etc.

If they don't have one (of any of them) they probably aren't legal.
That sure is a hard one to find out.

But not impossible.

You can ask the person you're hiring for a legal green card, but most of them have fake so you can verify with your local INS if its a legal green card.

Require a social secrity card or a green card, when you hire, you should have a form they fill out about naturalization. You can always require them to be fingerprinted too, fingerprinting costs about 5 dollars and you can have it done at your local sherriff's department, then running the prints through the system is about 15, that way you will know if they are felons too or on a sex offender registry. The fingerprinting will give you an extra layer of protection so you know they are not using a stolen or counterfeit Social security card and id.
Get documentation? Duh!
Employers just have to spend the money on credit reports to verify the information a person gave. They can also check with the IRS and DMV to verify the driver's license they have is valid. Checking the DMV is cheapest though.
You can't, but if you get copies of the right paperwork (Green Card, Work Visa, SS card, whatever) then you can't get in trouble. Plausible deniability baby.
I think the social security numbers or the visa help to avoid that but i'm not sure
In the UK it is all about due dillegence, You are not a customs official must must take reasonable steps to ensure the person has the right to work. You also dont want to be racist so need to ask every employee for same information (yes even people you know are American) and then keep photocopies on file.

I always take a photocopy of passport / visa and sign it to say what day I saw the original, I take National Insurance details and bank account details.
