Boss won't pay her employees or is always a week or so late.?
Answers:
Let's take these one at a time:
-you must be paid on time, every time. Companies must schedule their paydays and post a sign telling employees when they will be paid. If you are not paid on time, contact your local labor board - www.dol.gov should get you the link.
-you should file for and should receive unemployment if you get laid off.
-if you quit because you are not getting paid, it should fall under the heading of a constructive discharge, meaning you quit because the conditions were such that you couldn't continue working. Although quitting a job doesn't automatically ensure that you'll collect UI like getting laid off does, under these circumstances it's likely that the UI office would permit you to collect. Who can continue working when they aren't sure if or when they'll get paid?
Talk to the labor board and see what they have to say about collecting UI if you quit - i think your chances are pretty good. Good luck.
Take him to court, that is illegal
quit.
if laid off, can file for unemployment
I believe by law they have to get paid...I think they should all get together and hire a lawyer. Of course they can file for unemployment only if they are laid off. If they quit they are SOL
One course of action you can take is turning them over to the Better Business Bureau and let them know the problems you are having with the company. If you have an attorney you could ask him or her for some advice. If you do not have an attorney, most will answer some questions or give some advice on a consultation basis free, just be sure you find one that advertises this free service.
