Answer:
1) Yes.
2) FMLA allows for up to 12 weeks of UNPAID leave during any 12 month period for the care of a family member or if the employee is physically unable to work. Some employers allow you to receive pay in the form of vacation or sick time during this 12 week period.
3) FMLA may be used if the employee is physically unable to work.
4) The employer my pay the employee vacation during FMLA time. Vacation is not a benefit protected by Kentucky laws.
5) Too vague a question - however, the employer must have at least 50 employees within 75 miles for employees to be eligible.
6) FMLA is a Federal law - and it applies to all 50 states, not just Kentucky.
Note: Kentucky is an "at-will" state which means if the employee is not eligible for FMLA, the employer may terminate the employee without cause. FMLA was written to help employees balance work with family life - not to guarantee time off and preserve vacation time. FMLA allows for UNPAID leave and the guarantee of health benefits and a job on return in certain cases. Employers may, in their benevolence, pay the employee from accrued sick or vacation time. Kentucky also does not require vacation or holiday pay from employers.
It is called FAMILY MEDICAL LEAVE ACT. I am sure you can find plenty of info on the internet.
