Can a employer hold your pay check ?

Can a employer hold your pay check? If you quit your job, can they hold your paycheck? Lets say until you return all your uniforms?

Answer:
They are required by the Labor Board to provide you with compensation for the hours you worked, regardless of any other monetary dispute they may have with uniforms, etc; Unfortunately, most small companies just don't care, they'd rather get their stuff back than comply with the law. If they persist, you can certainly turn them in.
yeah it happens all the time
yeah.
yes they can.
Yes under those circumstances.
Not if you stick a gun in their face. I bet they give the check up real fast.
yes they can, they can hold it and if you do not return your check claim it as paying for your uniforms
Yes they can it's the law as soon as U return then then you'll get your paycheck.Good Luck
Yes they can. If it is written in their policy or employees handbook they can do whatever they have in writing.
THey can hold it for you to come get it and bring in the uniforms, pr they can deduct the "cost" of the uniforms from your last check. I don't think the whole check can be held for more the 2 weeks.
Are you required under the terms of your employment to return your uniform upon separation of employment or be held liable for the cost?

If yes, you owe them the value of your uniform. However, if your uniform cost is $100 and your paycheck is for say $500, the owe you $400. If they fail to pay, you can sue them in small claims court, win the amount due, and possible damages. If your uniform cost is more than your paycheck, they may be able to hold it (within reason; they can't say a standard t-shirt is worth $800).

Best thing to do is to return your uniform. If you've lost it, calculate the cost vs. what they owe you. You may be able to contact the state department of labor for questions.
They can deduct the cost of the uniforms from the balance of your check. That must be one heck of a uniform to be worth a week's (or two) pay! Also, check your employment contract; they may have slipped a proviso in there regarding uniforms.

If you file a complaint, they will ask you to return the uniforms to resolve the dispute yourself; they have enough trouble on their hands already.

Barring any proviso, the FLSA requires that you be paid. Hopefully you can get their stinking uniforms back to them and get this resolved quickly.
Employer has got right under the agreement executed between the employee and employer to hold the pay at the time of quitting job till he submit no due certificates from all the concerned departments of the company. Uniform provided must be returned. When all these formalities are completed, the employer has to release the salary.
