There is a loophole though. If an employer can demonstrate that there is a bonafide occupational qualification (BFOQ) to discriminate, then it is permitted. For example, Victoria's Secret only uses women in their runway shows because they design lingerie. A 250lb male construction worker couldnt apply for a Victoria's Secret modeling job, get rejected, and claim discrimination. On the other hand, if Victora's Secret hired no men anywhere in the organization, then they would likely be guilty of discrimination.

Hooters, the restaurant chain, is frequently involved in lawsuits where server applicants claim discrimination. Hooters argues that their business is basically providing their mostly male customer base an innocent sex thrill so the company stands its ground in the face of discrimination criticism. However, they do settle a lot of claims out of court.

Bottom line: unless there is some strong and valid reason that only blue-eyed blondes are hired, the practice is likely discriminatory.

Probably in most cases. Unless it's some sort of modeling gig in which the person needs to be blonde/blue.

A person has the right to hire whomever he or she wants, for any reason according to Freedom of Association. It may or not be morally reprehensible depending upon the circumstances, but it's not the purpose of the law to mandate the employment of people.

The same applies to the most idiotic law in history, the so-called "minimum wage."
The grey area there is that it depends on what kind of Business it is. A club called "Blondies" , for Instance, may be able to get away with it because it may be a part of their theme. But for a business where the employees have no direct contact with the clients, it's illegal.

It depends on the job. I've had to hire models for a specific look before.nothing illegal.but hair colour was important.she had to be a younger version of an actress playing the lead in a movie. but other than circumstances like that. I would think that it would be discriminatory.

To advise, no. Now if they are not the most qualified, there might be discrimination there. I would wonder why anyone would try to work there after finding that out.

But seriously, it is illegal unless there is a specific call for that.for instance a certain acting role that the script definitely requires that type of actor/actress.

it is discrimination, but that kind of discrimination that is illegal is defined by denying employment based on color, race, religion, age national origin, if the hiring is based on non-employment related qualities, such as experience, skilss, education etc. than it could be charged that the employment decision was the above and difficult to defend. My advise is the stick to those skills necessary and choose the best candidate for the job
Yes undoubtly so! Discrimination is the word and it is a crime ; it is punishable by the court system! Whoever is knows that this is going on should let authorities know and put a stop to it because everyone should be given a fair chance no matter what their facial appearance!
