Americans with disability act discrimination?
Would I get the job or a money settlement
Answer:
You would have to have a very sound argument, if so they would most likly give you a pay off, but the suit process will cost you a pretty penny. May not be worth your time.
How do you feel like you were discriminated against? You still have to be better then all other candidates. It can be hard to prove.
When safety is involved, I don't believe an employer will ever put a person on the job. But if a person applies for a job where his disability directly negates his ability to do that job, it hardly seems fair to the employer or customers to get sued.
Except for referees; they can be blind and it's no problem.
I sincerely hope you find something to do; I always like to hear that people with disabilities are trying to work. Good luck!
Here's a case about a guy who sued under ADA when he was fired for his hypertension: http://supct.law.cornell.edu/supct/html/.
I hope there's something there to help you make your decision.
