Disciplinary Action. Help?
There are no proves but everybody is trying to blame each other and giving names to the bosses, they choose him to make an example.
His company(A) works inside other company(B) as contractores but they dont treat very welll the staff and someone is sending anonymus letters to the B company calling attention for some internal problems.
Can you give us some advise about what to do in the enquire meeting as i think they want to sack him.Should he say nothing or should he be nasty as they have no proves and is very depressed,Should he be nice and tell them all they ask?Any information about this appreciated.
Answer:
first do you have a union? You should ask to see all letters and any allegations before the meeting, so you can comment fairly on what he has been accused of. You need them to tell you who has accused him of what and give any evidence he has of who may be the culprit. He can always go for unfair dismissal.. You may wish to get legal advice - it is worth calling into the employment office and asking for their leaflets on unfair dismissal and any thing they have on disciplinary action.. they will also have leaflets on employment law.. these links may also help? You can also contact ACAS.
sounds more like a school yard dispute.he said she said..
He should be very professional and point out calmly that there is no proof against him. He should also try to build up a case for himself by only quoting straight facts about what's happening around him.
If you feel that your friend has a legitimate defense and has done no wrong, he should consult an attorney about his situation and options he can take.
I will say this: Anyone who is accused of something has the right to know what they are accused of and why, and who is accusing them. Anything else is troublemaking and to be ignored.
i agree with janiffer because these things usually centre around using people as a scapegoat
If he's in UK tell him to get down to Citizens Advice (best ring for an appointment) for some free legal advice, or talk to his union rep if he has one.
Do you have a union represenative to talk to? If you do go to that person immedeately! If you don't then he should ask that he be allowed to have someone accompany him in the meeting as a witness. (If you are that person, take paper and pen and keep notes as to who says what, especially who is making the strongest accusations.) He should ALWAYS be respectful! He will be seen as a man who can be respected back. He should answer all the questions asked of him as truthfully as possible. If he knows who is the one doing the wrongs, but doesn't want to give out that information, he should say " I am not at liberty to give any information about that." Always keep your anger inside! The company may try to "bait" him into getting angry so they can dismiss him because of dis-respecting one of them. Last, at the end of the meeting (if he isn't dismissed!) offer to shake hands with the company people. This shows them you both have respect for them and they will see you as respectable persons.
first before the meeting he should ask for copies of the evidence and take time to read them. he should when he goes into the meeting take a note pad and write down everything which is said. if he needs to ask them to stop untill whoever is writing has caught up. this will give a record of what is said and slow the questions down giving him time to think about what he is saying. you can adjourn at any time. if the questions are coming too fast then take a short break. dont get annoyed stay calm and do not offer up other suspects as the others have done. any evidence from others presented must be signed and you have the right to question them insist on this. others are very willing to spout untill they are put under this kind of pressure and most refuse to sit and be questioned by the accused and withdraw their statements. this then leaves them with no evidence for a dismissal
Best thing for him to do is to get all of the facts down on paper.
Make it a factual report and no personal asides.
The Citizens advice Bureau will often help and can provide a representative to go along to assist.
Good luck.
