I'm going to meet up with an attorney, what questions should i ask due to misconduct led to termination?
Answer:
Well any attorney worth a hill of beans is going to do most of the asking. You need to be completely honest, lay out your side of the situation and go from there. My suggestion is to get yourself a legal pad and write down EXACTLY what happened. Be clear, be concise, and above all be honest. Give the good and the bad. Make sure the attorney knows every single detail. This will help him/her put your case together.
If you were terminated due to misconduct I don't think you have much of a case. As far as an illness, if you are in a union, you may have somewhere to go with that. Most unions have in their contracts that you can't be terminated if you are out on medical leave. However it sounds like you were still working so I'm not sure what kind of a case you think you might have.
