i have an idea for a food product that is not on the market anywhere that i can find. the product uses some existing food products on the market. without giving away my idea i will just use this example: some trail-mix's that you can purchase packaged in anystore have M&M's in them or other brand name products. my question's are to anyone that may be able to help with this are as follows: (1) do you need permission to use that product? (2)do you have to pay for the use of that product? (3)can i take several brand name products and package it with my name on it, mass produce it and sell it? (4)can i do this legally as long as i provide the names of the products on the package as a registered trademarks for each of said products? (5) can i use the FDA nutrition labels of each product to my advantage and compile my own label? i know there is a formula for reducing or increasing serving sizes that can be worked out using the available nutrition labels of any product.

1.) You should not need permission to re-use or re-sell a product that you buy. You get an "implied license" to use any product that you buy.
2). No. You are paying to buy the product and that ends your obligation.
3.) Yes.
4.) Yes, and you do not need to put the names of the "ingredient products" on the label. In fact, I wouldn't because any use of a trademark invites scrutiny by the owner.
5.) Yes, but you will need to satisfy FDA label requirements. See
