If this company is in the U.S. there's nothing to make it illegal, unless he's not paying taxes. (And then that doesn't make the development of the company illegal.) There's no certification or licensing or anything that is necessary to have a marketing company. There are organizations you can join that make your company more "legitimate," like AMA, AAAA, PRSA, etc., but they are not necessary to having a business. So I'd say that it's entirely possible that this kid has legimately started his own marketing company.
IT MAY NOT BE LEGAL.BUT I THINK HE CAN WORK IN THE NAME OF HIS GUARDIAN TILL HE BECOMES MAJOR. SECONDLY OF HIS SUCCESS, INTELLIGENCE IS CONGENITAL, IT CANT BE ACQUIRED. THE ENTREPREUNER MIGHT BE HARDWORKING SO THAT HE/SHE MADE MORE USE OF HIS/HER POTENTIAL.
